Terms of Use of Gromadan

Welcome to Gromadan.

These Terms of Use govern the use of the Gromadan website, its pages, features, services, and user content.

By using Gromadan, creating an account, posting materials, publishing listings, or using other features of the site, the user confirms that they have read these Terms and agree to comply with them.

Certain Gromadan features may have additional terms that apply together with these Terms.

1. About Gromadan

Gromadan is an online platform for communication, posts, local communities, and classified listings.

Depending on the availability of specific features, users can:

create personal profiles;
publish posts, photos, and other materials;
communicate and exchange messages;
find users by city and interests;
use dating features;
post and browse listings;
post and search real estate listings;
post and search job offers;
use other features available on the site.

The set of Gromadan features may change as the platform develops.

2. Who may use Gromadan

Gromadan is intended for users who are at least 18 years old.

By using Gromadan, the user confirms that they are at least 18 years old and have the legal capacity to enter into agreements under applicable law.

The user must not create an account or use Gromadan features on behalf of a minor.

If Gromadan receives information about a violation of the age restriction, the relevant account or content may be restricted or removed.

3. User account

Registration is required to use certain features.

The user must provide accurate information within the data required for the relevant feature to work.

The user is responsible for keeping their account login details confidential and must promptly notify Gromadan if they suspect unauthorized access.

It is prohibited to:

use someone else’s account without permission;
impersonate another person;
create accounts for the purpose of deception or service abuse;
use an account for illegal activity;
give other people access to an account in a way that compromises platform security.

Gromadan may apply technical and organizational measures to protect accounts and prevent abuse.

4. User content

User content refers to materials that a user posts or transmits through Gromadan.

This may include:

photos;
images;
posts;
text;
comments;
videos;
profiles;
listings;
reviews;
links;
messages and other materials.

The user is solely responsible for the legality of the content they post.

By posting material on Gromadan, the user confirms that:

they have the necessary rights to post it;
they have the necessary permissions from any persons depicted or mentioned, where such permissions are required;
posting the material does not violate the law;
the material does not infringe the rights of third parties;
the material complies with these Terms and the Community Guidelines.

5. Rights to user content

Intellectual property rights to material lawfully created by a user remain with the user or other rights holder.

By posting content on Gromadan, the user grants Gromadan a non-exclusive, royalty-free, worldwide license to the extent necessary to:

store the material;
process it technically;
reproduce it;
display it;
transmit it to other users in accordance with the selected visibility settings;
adapt the material to the platform’s technical requirements;
back it up;
operate, secure, and develop the relevant Gromadan feature.

This license does not transfer ownership of the user content to Gromadan.

Gromadan does not acquire the right to sell user content separately from the operation of the relevant platform feature, unless otherwise expressly agreed with the user.

After the user deletes material, further use of it stops to the extent technically and legally possible; however, individual copies may remain in backup systems, security logs, report materials, or in other cases provided for by these Terms, the Privacy Policy, or applicable law.

6. Photos and images of people

The user must only post photos and images that they are legally permitted to use.

In particular, the user must not post images of other people if such posting requires consent and the necessary consent has not been obtained.

It is not permitted to post:

intimate images of another person without the necessary consent;
images of documents;
bank cards and payment details;
third parties’ personal data without a legal basis;
materials that infringe copyright or other rights.

Ukrainian law sets out special rules for the use of an individual’s image, including the need for consent in cases established by law.

7. Prohibited use

The user must not use Gromadan to:

engage in or promote illegal activity;
commit fraud;
extort or blackmail;
engage in phishing;
distribute malicious software;
steal or use another person’s identity;
unlawfully collect personal data;
harass, threaten, or systematically bully others;
distribute spam;
manipulate platform ratings and metrics;
circumvent restrictions;
automate abuse of site features;
gain unauthorized access to accounts or data;
infringe copyright and related rights;
post content prohibited by law;
use Gromadan in a way that creates an excessive load on the infrastructure.

8. Rules of conduct

The user must treat other users with respect.

It is prohibited to use Gromadan to:

threaten physical harm;
harass;
blackmail;
humiliate or bully;
publish another person’s private information with intent to cause harm;
deliberately target individual users for bullying;
impersonate Gromadan representatives or other people.

Detailed rules of conduct and content requirements are set out in the Community Guidelines.

9. Dating and communication

Dating features are intended for adult users.

Gromadan provides the technical means to meet and communicate but does not verify the accuracy of all information users provide in their profiles.

The user makes their own decisions regarding communication, sharing contact details, meeting in person, and other actions outside the platform.

It is not permitted to:

impersonate another person;
create fake profiles for fraudulent purposes;
extort;
threaten;
share intimate materials without the necessary consent;
exploit other people;
use dating features for illegal purposes.

10. Messages and non-public communication

Some Gromadan features allow users to exchange non-public messages.

A non-public message does not become a public post simply because it was sent through the platform.

Messages and other technical data may be processed to the extent necessary to operate the service, ensure security, investigate abuse, review reports, and comply with legal requirements.

Gromadan does not guarantee absolute confidentiality of communication when using features that, by their nature, involve technical processing, storage, or review of messages.

The user must not send passwords, payment details, or other information through messages if disclosure could pose a risk to them or another person.

11. Anonymous and incognito features

Some Gromadan features may allow users to interact without displaying a full public profile.

Such a feature does not mean absolute technical anonymity.

Gromadan may process technical identifiers, information about user actions, and other data necessary to operate the feature, prevent abuse, and protect users.

The user must not use anonymous features to circumvent restrictions, harass others, or engage in illegal activity.

12. Posts and comments

The user is solely responsible for the content of their posts and comments.

Published material must comply with:

applicable law;
these Terms;
the Community Guidelines;
copyright requirements;
personal data protection requirements.

Gromadan may restrict, hide, or remove materials that violate the rules or require restriction under law.

13. Listings

Gromadan allows users to post listings.

The author of a listing is solely responsible for:

the accuracy of the information;
the availability of the item, property, service, or offer;
the legality of the listing;
the photos;
the documents and information they publish;
the contact details provided;
compliance with the rights of third parties.

Gromadan does not automatically verify the accuracy of every listing and does not guarantee that any user, seller, landlord, employer, buyer, or other party will fulfill their obligations.

14. Real estate

Real estate listings are posted by users unless expressly stated otherwise by Gromadan.

Gromadan is not automatically:

a seller of real estate;
a buyer;
a landlord;
a tenant;
an agent;
a notary;
an appraiser;
a legal advisor;
a party to an agreement between users.

Information published in a listing may be incomplete or may change after publication.

Before entering into a transaction, the user should independently verify:

ownership;
documents;
the authority of the person involved;
the actual condition of the property;
encumbrances and restrictions;
the price;
the terms of the transaction;
other relevant circumstances.

15. Jobs and vacancies

Gromadan may allow users to post job offers and search for employees.

The author of a job listing is solely responsible for its content and accuracy.

Gromadan is not an employer merely because a vacancy is posted, and does not guarantee:

the existence of the employer;
the conclusion of an employment contract;
the amount of salary;
working conditions;
the accuracy of information in the vacancy.

The user should independently verify the employer and the working conditions before transferring money or providing documents and personal data.

16. Content reports

Users may report material or conduct that, in their opinion, violates the law, these Terms, the Community Guidelines, or the rights of third parties.

The Report feature is used for this purpose.

Depending on the circumstances, Gromadan may:

request additional information;
temporarily restrict access to the material;
hide or remove the material;
restrict certain features;
suspend the account;
delete the account;
leave the material unchanged if the violation is not confirmed.

Submitting a report does not mean that any disputed material will automatically be removed.

Certain copyright-related requests may be governed by a special statutory procedure. The Law of Ukraine "On Copyright and Related Rights" sets out special rules for protecting rights online and the obligations of participants in such procedures.

17. Copyright

The user must not post works, photos, videos, text, music, program code, or other objects if they do not have the necessary rights to use them.

If a rights holder believes that material on Gromadan infringes their rights, they may submit a request through the designated reporting channel or to the contact address: zavskladom.adm@gmail.com

The request must contain the information needed to identify the disputed material and review the claim.

Gromadan may restrict access to the disputed material or take other measures in accordance with applicable law.

18. Moderation

To maintain functionality, security, and legal compliance, Gromadan may apply automated and manual moderation measures.

Moderation may take into account:

the content of a post;
images;
user reports;
a history of violations;
technical indicators of spam or abuse;
other circumstances necessary to ensure platform security.

Moderation does not guarantee that any prohibited material will be detected automatically or immediately after publication.

19. Account suspension and restriction

Gromadan may temporarily or permanently restrict access to an account in cases of:

violation of these Terms;
violation of the Community Guidelines;
illegal activity;
fraud;
a threat to the safety of users or the platform;
repeated violations;
circumventing previously applied restrictions;
knowingly providing false information where this is material to the use of the service;
other serious abuse.

Depending on the nature of the violation, a restriction may be applied without prior notice.

The user may contact Gromadan to appeal an erroneous restriction.

20. Deleting an account

The user may delete their account using the available site features or by contacting Gromadan at the contact address.

After an account is deleted, some data and materials may be retained for the period necessary:

to comply with legal requirements;
for security purposes;
to prevent fraud;
to review reports;
to resolve disputes;
to protect the rights of Gromadan or other persons.

21. Service availability

Gromadan strives to maintain stable operation of the platform; however, certain features may temporarily become unavailable.

Reasons may include:

technical maintenance;
software updates;
infrastructure failures;
actions by hosting providers or other suppliers;
cyberattacks;
emergency circumstances;
circumstances beyond Gromadan’s reasonable control.

Gromadan may change, suspend, or discontinue certain platform features.

This provision does not limit user rights that cannot be limited under mandatory provisions of law.

22. Third-party services and links

Gromadan may use third-party services and contain links to third-party sites.

Depending on the platform’s current configuration, such services may include:

analytics services;
advertising platforms;
payment systems;
email services;
infrastructure and technical services.

Use of a third-party service may be governed by the separate terms and policies of the relevant provider.

Gromadan does not control the content and rules of all third-party sites.

23. Advertising

Advertising may appear on certain Gromadan pages.

Advertising materials may be provided by Gromadan or by third-party advertising partners.

The advertiser is solely responsible for the advertised product, service, or offer within the limits of applicable law.

The placement of an advertisement on Gromadan does not by itself mean that Gromadan endorses or guarantees the advertised product or service.

The user should independently review the terms of the relevant offer before making a purchase or taking other action.

24. Paid features

If Gromadan offers paid features, their price, duration, payment method, and other material terms are indicated directly before the relevant service is ordered.

Certain paid features may be subject to additional terms that form part of the relevant electronic contract.

The user should review the terms and price before confirming payment.

Consumer rights that are mandatory under Ukrainian law are not limited by these Terms.

The procedure for refunds or termination of a paid service is determined by the terms of the relevant service and applicable law.

25. Electronic contracts and user actions

Where an electronic contract is concluded between Gromadan and the user, such a contract may be entered into through actions taken by the user via the site interface.

Depending on the specific service, such actions may include:

confirming an order;
clicking the relevant button;
accepting the terms;
making a payment;
using an electronic identifier provided by the system;
another action specified in the terms of the particular service.

The Law of Ukraine "On Electronic Commerce" recognizes an electronic contract as an agreement made in electronic form and provides for various ways of confirming a party’s intent.

26. Gromadan’s intellectual property

The Gromadan name, design elements, program code, site structure, graphic elements, text, and other materials created by Gromadan or lawfully provided to it are protected under applicable law.

Without appropriate permission, it is prohibited to:

copy substantial parts of the site;
reproduce design elements;
use the Gromadan name or marks in a way that creates a false impression of affiliation with the platform;
extract data from the site in a way that disrupts the platform’s operation;
use software or automated tools for mass data collection without permission.

27. Personal data

Personal data is processed in accordance with the Gromadan Privacy Policy and applicable law.

The user must only provide other people’s personal data if they have a lawful basis for its processing or publication.

Use of the site’s features is also governed by the rules for processing cookies and similar technologies set out in the Cookie Policy.

28. Security

The user must not:

attempt to gain unauthorized access to servers;
bypass security mechanisms;
scan the infrastructure with the intent to disrupt its operation;
distribute malicious code;
use automated requests that create an excessive load;
attempt to obtain data to which they have not been granted access.

29. Limitation of liability

Gromadan provides the platform within the limits of available technical capabilities.

Information posted by users may be inaccurate, outdated, incomplete, or untrue.

Gromadan does not guarantee the accuracy of any user profile, listing, post, vacancy, or other material.

Gromadan is not automatically a party to relationships between users and does not guarantee the outcome of transactions, dating, employment, rentals, purchases, or sales arising directly between users.

Nothing in these Terms excludes or limits liability or rights that cannot be excluded or limited under mandatory provisions of Ukrainian law.

31. Changes to the Terms

Gromadan may update these Terms due to:

changes in the law;
the development of new features;
changes to the technical infrastructure;
the introduction of new services;
changes to how the platform operates;
the need to improve security.

The current version is published on this page.

The date of the last update is indicated at the top of the page.

In the case of material changes, Gromadan may additionally notify registered users through means available on the site.

Changes do not deprive the user of mandatory rights provided by law.

32. Governing law

These Terms are governed by the law of Ukraine to the extent applicable to the relevant relationship.

The provisions of these Terms must not be interpreted as a waiver by the user of rights granted to them by mandatory provisions of law.

33. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect to the maximum extent permitted by law.

Gromadan’s failure to enforce a particular provision in a specific situation does not constitute a waiver of that requirement in the future.
